Terms of Use

These terms apply when you use the ScorePuppy app or website (the "App"). "We", "us" and "ScorePuppy" mean BraindAI Pty Ltd (ABN 61 701 238 968), Australia. "You" means anyone using the App: a player, parent or guardian, fan, team captain or manager, or league organiser. By using the App you agree to these terms and to our Privacy Policy.

1. What ScorePuppy is

ScorePuppy helps sports leagues, amateur or professional, share fixtures, scores, tables, player stats, "Are you playing?" answers and league news. Each league is run by its organiser, not by us. We provide the tool; the organiser decides who is in the league, what is entered and how the league is run.

2. Using the App

• No account needed for most people. You can join a league with its code. If you want to keep your access on a new phone, create a league, or manage a team, you may need to add an email address.
• Invite codes and league codes give access to a league; only share them with people who should have it.
• Age. You need to be 18 to create an account, register yourself as a player, or run a league (as its owner, moderator, captain or team manager). For a junior or school league, a parent, coach or teacher sets it up and runs it; younger people can help them, without an account. Under-18s are added by a parent or guardian, or by an organiser who confirms a parent or guardian agreed. Teens aged 13–17 can use the App on their own phone only when a parent connects it: they see their games and reminders and can answer "Are you playing?". Children under 13 don't use the App themselves.
• If you add someone else (for example your child), you confirm you are allowed to do so.
• Your account. Keep your password and codes to yourself, and tell us straight away at hello@scorepuppy.com if you think someone else has used your account or your league's codes. You are responsible for what happens in your account until you tell us.

3. Your content

"Content" is anything entered into the App: names, numbers, photos, results, stats, answers, announcements and feedback.

• You keep ownership of the content you enter. You give us a non-exclusive, worldwide, royalty-free licence to store, copy and display it as needed to run the App for your league.
• Only enter content you have the right to share, and that is accurate as far as you know.
• Don't enter anything unlawful, defamatory, discriminatory, harassing, or that breaches someone's privacy or rights.
• Organisers and their staff can edit or remove content in their league. We may also remove content or restrict access if it breaks these terms or the law, or puts someone at risk.
• Copyright and other rights. If something in the App uses your work, photo or name without permission, report it as described below and we'll look at it and remove it where appropriate.
• Report a problem: in the App, Settings → Send us a message → Report, or email hello@scorepuppy.com. Tell us the league and what happened. We aim to review reports within 2 business days, and can remove content or block a person from the App.

4. Things you must not do

Don't:

• try to access leagues, accounts or data you weren't given access to;
• impersonate someone, or claim a player profile that isn't yours ("That's me" requests must be genuine);
• copy, scrape, resell or reverse-engineer the App, or interfere with how it works;
• use the App to send spam or to contact people outside what the App is for;
• use the App to harm, exploit, groom or endanger anyone, especially children. We remove such content, close the accounts involved, and report it to the police where appropriate.

5. Paid plans (Club and Club Pro)

• The App is free for players, parents and fans. Organisers can buy a Club or Club Pro plan for extra league features.
• Plans are subscriptions billed through Apple (App Store) or Google (Google Play) under their terms. Prices are shown in the App before you buy, and include any taxes the store applies.
• Free month. New subscribers get the first month free. Unless you cancel at least 24 hours before the free month ends, your subscription starts automatically at the price shown, and then renews each month or year. One free month per person (Apple ID or Google account).
• A subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. You can manage or cancel it in your App Store or Google Play account settings.
• Refunds are handled by Apple or Google under their policies. You can also contact us at hello@scorepuppy.com about a problem with a paid plan. This doesn't limit your rights under the Australian Consumer Law.
• Deleting your account doesn't cancel a subscription. Cancel it in your App Store or Google Play account first, or you'll keep being charged.
• If a plan ends, the league keeps working on the Free plan; paid-only features stop (and extra leagues or teams can't be added) until the plan is renewed. No data is deleted because a plan ended.
• We may change prices or plan features. Price changes for an existing subscription follow the store's rules, including telling you in advance.

6. League fees

League fees, payment links and "I've paid" status are between the league and its players. Payments happen outside ScorePuppy. We don't handle that money and aren't responsible for it, including refunds.

7. Notifications

Notifications and reminders are sent on a best-effort basis. Phones, settings and networks can delay or block them. Check the App for the latest game times, and don't rely on ScorePuppy for anything safety-critical.

8. Our service

• We work to keep ScorePuppy secure, available and accurate, but we provide it "as is" and don't promise it will always be available or error-free.
• Results, stats and game details are entered by leagues. We don't check them and don't guarantee they're correct.
• Our app. ScorePuppy, its design, code, name and logo belong to BraindAI Pty Ltd. We give you a personal, non-exclusive, non-transferable right to use the App for its purpose while these terms apply. If you send us ideas or feedback, we may use them without owing you anything.
• We may change, add or remove features. If we stop running ScorePuppy, we'll give reasonable notice where we can, and any paid plan will be handled under the store's refund rules.

9. Liability

To the extent the law allows:

• we aren't liable for how a league is run, for decisions made by organisers or their staff, or for content entered by users;
• we aren't liable for indirect or consequential loss, or for loss of data, profits or opportunity;
• our total liability to you is limited to the greater of A$100 and the amount you paid for ScorePuppy in the 12 months before the claim.

Your responsibility. To the extent the law allows, you are responsible for loss or claims caused by your breach of these terms or by content you enter, and you agree to cover our reasonable costs of dealing with them. This doesn't apply to the extent we caused the loss.

Things outside our control. We aren't responsible for delays or failures caused by events we can't reasonably control, such as outages of our providers, networks or app stores.

Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those guarantees, or any similar rights you have under the law where you live.

10. Ending

• You can stop using the App at any time. You can delete your account, or this phone's data if you don't have one, in the App (Settings → Delete my account or data).
• We may suspend or close access for anyone who breaks these terms, misuses the App or puts others at risk. Where it's reasonable, we'll tell you first.

11. Apple users

If you downloaded the App from the Apple App Store, Apple's Licensed Application End User Licence Agreement also applies. These terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for the App and isn't responsible for claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.

12. Changes

We may update these terms. If the changes are significant, we'll tell you in the App before they apply. If you keep using the App after that, the new terms apply.

13. Law

These terms are governed by the laws of New South Wales, Australia, and the courts there have jurisdiction. This doesn't take away consumer rights you have under the law where you live.

14. General

• If a part of these terms can't be enforced, the rest still applies.
• If we don't enforce a right straight away, we can still enforce it later.
• We may transfer these terms to whoever takes over ScorePuppy; we'll tell you in the App first. You can't transfer your rights under them.
• These terms, the Privacy Policy and (for organisers) the Organiser Terms are the whole agreement between you and us about the App. Parts that by their nature should continue (for example liability and your responsibility) continue after you stop using it.
